Terms of Use

These terms (the "Terms") govern your use of the Flamme app (the "Service"), published by [TO COMPLETE: company name] ("Flamme", "we"), whose details are in the legal notice. By creating an account, you accept them along with the community guidelines. The privacy policy explains how we process your data. The French version prevails in case of discrepancy.

1. Eligibility

To use Flamme, you must:

You verify your phone number when signing up. You are responsible for keeping your sign-in methods (email, Apple or Google account) secure.

2. The Service

Flamme lets you create a profile, discover other members' profiles according to your preferences, like them, and talk to them by message, then by audio or video call if you both turn calls on.

The free Service includes a limited number of likes per period. Additional features are available for a fee (section 6).

Flamme's source code is published under a free software licence (AGPL-3.0). This licence covers the software, not the Service operated by Flamme, nor members' content.

We do our best to keep the Service available but cannot guarantee it at all times. We may change the Service and add or remove features. If a change removes a paid feature during a paid period, we refund you pro rata.

3. Your content

You keep ownership of the photos, texts and other content you post. You grant us a non-exclusive, royalty-free, worldwide licence, limited to what is needed to run the Service: hosting, copying, resizing and showing your content to other members. This licence ends when you delete the content or your account, except for copies kept for the reasons explained in the privacy policy.

You confirm that you hold the rights to what you post and that your photos show you. You do not post a photo of someone else without their consent.

4. Rules of conduct

You agree to follow the community guidelines and the law. In particular, the following are forbidden:

What you do when meeting someone outside the app is your responsibility. Read our safety tips before meeting anyone.

5. Reports and moderation

Reporting. You can report a profile or conversation from the app (the shield in a conversation, or a profile's menu). Anyone, even without an account, can report illegal content to [TO COMPLETE: report@domain], stating the content concerned, the reason, and their contact details.

How we moderate. Profile photos are analysed automatically when uploaded: photos that appear to contain nudity, violence or a minor are rejected or held for review by the team. Photos sent in conversations are analysed too: those that look sensitive arrive blurred, and the recipient chooses to show or report them. Reports are reviewed by a team member, who may read the conversation concerned.

Possible measures, depending on severity: rejection or removal of a photo, warning, reduced profile visibility, temporary suspension, permanent ban. Clearly illegal content may be passed on to the authorities.

Notice and appeal. When a measure affects you, we tell you the decision, its reasons and how to challenge it, unless the law or someone's safety prevents it. You can appeal by writing to [TO COMPLETE: moderation@domain] within 6 months: another team member will review the decision. You may also go to a certified out-of-court dispute settlement body, or to court.

Points of contact. For authorities and members: [TO COMPLETE: contact@domain], in French or English.

6. Subscriptions and purchases

Offers. Flamme Plus and Flamme Gold are subscriptions that unlock features (unlimited likes, rewind, Passport, see who liked you, Top Picks, monthly Boost…). Super Likes and Boosts are also sold individually. What each offer includes and its price are shown before purchase.

Payment. Purchases are made and billed through the App Store (Apple) or Google Play, under their terms. Prices include taxes.

Renewal. Subscriptions renew automatically for the same duration unless you cancel at least 24 hours before the end of the current period, in your Apple or Google account settings (Settings > Manage subscription in the app takes you there). Cancellation takes effect at the end of the paid period.

Right of withdrawal. By confirming a purchase, you request immediate access to digital content and acknowledge that you lose your 14-day right of withdrawal (Article L221-28 of the French Consumer Code). Refund requests are handled by Apple or Google under their rules.

End of account. Deleting your account does not cancel your subscription with Apple or Google: remember to cancel it too. Unused one-off purchases are lost when the account is deleted. No refund is due if you are banned for breaching the Terms.

Restore. If you change phones, use "Restore purchases" in Settings.

7. Term, suspension and deletion

The Terms apply as long as you have an account. You can delete it at any time from Settings > Delete my account; deletion is immediate and permanent.

We may suspend or close your account if you breach the Terms or the community guidelines (section 5), or if your account has been inactive for 2 years.

8. Liability

Flamme connects people and is not a party to the exchanges or meetings between members. We do not verify every member's identity: the "verified" badge only means a selfie was compared with the profile's photos.

We are only liable in case of fault on our part, and for direct and foreseeable damage. Nothing in these Terms limits the rights you have by law as a consumer.

9. Changes to the Terms

We may change these Terms. We notify you in the app at least 30 days before a new version takes effect, with a summary of the changes. From that date, you must accept the new version to keep using the Service. If you refuse it, you can delete your account and exercise your data rights.

10. Governing law and disputes

These Terms are governed by French law. In case of a dispute, please write to us first at [TO COMPLETE: contact@domain]. If no agreement is reached, you can use the consumer mediator free of charge: [TO COMPLETE: mediator name and details]. Otherwise, the courts designated by law have jurisdiction; as a consumer, you may bring the case before the court of your place of residence.
